This Acceptable Use Policy (the 'Policy') sets out how the User may use the eSIM Surfer application and the eSIM plans purchased through it (together, the 'Service').

This Policy forms an integral part of the Terms and Conditions. By using the Service or placing any order, the User accepts that this Policy is binding on them.

1. Purpose and scope of the Policy

The purpose of this Policy is to protect the Service, the underlying mobile networks and other users against abusive use. It applies to use of the application and to all data traffic transmitted through purchased eSIMs.

The terms of the Provider's contracted eSIM partners, in particular wholesale eSIM providers and local mobile-network operators, may also apply to the relevant plan.

2. General principles

The User may use the Service only:

• as intended, in good faith and in compliance with applicable laws,
• for personal, non-commercial purposes, and
• in the countries/regions specified in the plan description

The User is responsible for all traffic transmitted through the eSIM on their devices and for keeping their account credentials confidential.

3. Prohibited activities

In particular, the following activities are prohibited when using the Service:

• engaging in unlawful, fraudulent or deceptive activity, including fraud, phishing and identity theft;
• sending unsolicited messages (spam) or mass or automated communications;
• distributing malicious software (viruses, malware), or gaining or attempting to gain unauthorised access to other systems;
• jeopardising or overloading the operation, security or performance of the Service, application or underlying mobile networks;
• reverse-engineering the application, deciphering its source code, circumventing security measures or collecting data in bulk using automated tools (robots, scrapers);
• reselling, renting out, transferring to a third party or commercially sharing eSIMs or the Service without the Provider's prior written consent;
• using the eSIM for persistent machine-to-machine (M2M/IoT) communication, server operation, continuous monitoring connections or other bulk use unrelated to personal travel use;
• creating multiple accounts or misusing the referral programme, promotional codes or discounts;
• using the Service in a country or manner that breaches local telecommunications or other laws.

4. Fair use and speed restrictions

Fair-use rules apply to certain plans, particularly those with an 'unlimited' data allowance. Once the daily full-speed allowance has been used, connection speed may be restricted (throttled) to the level stated in the plan description; full speed is generally restored every 24 hours. The applicable daily allowance and restricted speed are shown on the relevant plan page before purchase.

Network operators may also apply traffic management under their own network-protection rules, independently of the Provider. Exceptionally excessive traffic incompatible with ordinary personal use may constitute abuse.

5. Internet sharing (tethering/hotspot)

The User may share the eSIM data connection between their own personal devices (personal hotspot) within the limits of fair use. However, operating the connection as a public or commercial hotspot, or regularly sharing it with third parties outside the User's household or travel companions, is prohibited. Some network operators may technically restrict tethering; the Provider accepts no liability for this.

7. Monitoring and consequences of breaching the Policy

The Provider may monitor use of the Service to detect abuse, in compliance with applicable data-protection rules. A breach of this Policy constitutes a material breach of the Terms, entitling the Provider to:

• suspend or terminate the User's access or the relevant eSIM without prior notice;
• refuse refunds for purchases affected by the breach;
• in serious cases, report the matter to the competent authorities and seek compensation for losses caused by the breach.

These provisions do not affect rights granted to Consumers by law.

8. Amendments to the Policy

The Provider may amend this Policy unilaterally. Users will be notified of amendments as set out in the Terms; continued use of the Service constitutes acceptance of the amended Policy.
